Terms of Service

1. Eligibility and Acceptance

By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence and have the legal capacity to enter into a binding agreement.

Revival Strips products are intended for adults. You may not purchase products through the Services if you are prohibited from doing so under applicable law.

If you use the Services on behalf of a business or another legal entity, you represent that you have authority to bind that entity to these Terms. In that situation, “you” includes both you and the entity you represent.

We reserve the right to refuse service, cancel an order, terminate an account, or restrict access to the Services when permitted by law.

2. Online Store Terms

Our online store is hosted through Shopify, which provides the e-commerce platform that allows us to offer and sell our products and Services.

You may not use our products or Services for any illegal or unauthorized purpose. You may not violate any law in your jurisdiction while using the Services, including intellectual-property, consumer protection, export-control, or privacy laws.

You must not transmit worms, viruses, malicious code, or any other technology intended to interfere with, damage, monitor, or gain unauthorized access to the Services or another person’s device, account, or information.

A breach of these Terms may result in the immediate suspension or termination of your access to the Services.

3. Health and Product Disclaimer

Statements regarding our products may not have been evaluated by the United States Food and Drug Administration. Our products are dietary supplements and are not medications or substitutes for professional medical care.

Information presented through the Services is provided for general informational and educational purposes only. It is not medical advice and should not be used as a substitute for consultation, diagnosis, or treatment from a licensed healthcare professional.

Before using any Revival Strips product, consult a qualified healthcare professional, especially if you:

• Are pregnant, nursing, or attempting to become pregnant;
• Are under medical supervision;
• Take prescription or over-the-counter medications;
• Use other dietary supplements or products containing caffeine;
• Have a medical condition;
• Have a sensitivity or allergy to any listed ingredient;
• Have a heart condition, high blood pressure, anxiety disorder, or sensitivity to stimulants; or
• Have been advised to limit or avoid caffeine or another ingredient contained in the product.

Always read the product label, ingredient list, warnings, directions, and serving information before use. Do not exceed the recommended serving. Consider your total daily intake of caffeine and other active ingredients from all sources.

Individual experiences vary. Reviews, testimonials, examples, and descriptions of customer experiences do not guarantee that you will experience the same or similar results.

Stop using the product and seek appropriate medical assistance if you experience an adverse reaction. If you believe you are experiencing a medical emergency, contact emergency services immediately.

4. Product Information and Availability

We make reasonable efforts to describe and display our products accurately. However, product photographs, packaging, colors, dimensions, appearance, and other details may differ slightly from the product you receive because of screen settings, photography, manufacturing changes, supplier updates, or packaging revisions.

Product descriptions and other website content are provided for general informational purposes. We do not warrant that every description, image, price, ingredient statement, or other piece of information will always be complete, current, or error-free.

Ingredients, formulation details, packaging, serving recommendations, and product availability may change when permitted by law. The information printed on the physical product label should be reviewed before each use.

All products are subject to availability. We may limit quantities, discontinue products, modify product offerings, or restrict sales by person, household, account, geographic region, or jurisdiction.

We reserve the right to correct product information and cancel or refuse orders affected by an error, even after an order has been submitted or payment authorization has been obtained. If we cancel a paid order, we will issue an appropriate refund.

5. Orders and Order Acceptance

Submitting an order is an offer to purchase the products identified in the order. An automated order confirmation acknowledges that we received your order, but it does not necessarily mean that the order has been accepted.

We may accept, decline, limit, or cancel an order in our reasonable discretion, including because of:

• Product unavailability;
• Incorrect pricing or product information;
• Suspected fraud or unauthorized activity;
• Payment-processing problems;
• Shipping restrictions;
• Suspected resale or commercial redistribution;
• Violation of these Terms; or
• Legal or regulatory requirements.

We may limit or prohibit orders that appear to be placed by dealers, resellers, distributors, or other unauthorized commercial purchasers.

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information. You are responsible for reviewing your order and correcting mistakes before completing checkout.

Contact us promptly if you discover an incorrect shipping address or other order error. We cannot guarantee that an order can be changed or canceled after it has entered fulfillment.

6. Pricing, Billing, and Payment

Product prices are displayed in United States dollars unless otherwise stated. Prices may change at any time without notice, but a price change will not ordinarily affect an order we have already accepted, except where correction of an obvious error is permitted by law.

Displayed product prices may not include applicable taxes, shipping costs, handling charges, or other fees. Any additional amount will be disclosed during checkout before you submit the order.

By submitting payment information, you represent that:

• You are authorized to use the selected payment method;
• The payment information you provide is accurate and complete;
• You authorize us and our payment providers to charge all amounts associated with your order or subscription; and
• You are responsible for taxes, fees, and other charges shown at checkout.

Payments are processed through Shopify and authorized third-party payment providers. We do not ordinarily receive or store your complete payment-card number.

If your payment is declined, reversed, disputed, or otherwise unsuccessful, we may suspend fulfillment, cancel the order, request another payment method, or take other lawful action.

7. Subscriptions and Automatic Renewal

Revival Strips may offer products through recurring subscriptions. Subscription details—including price, delivery frequency, included products, discounts, and renewal timing—will be displayed before you complete enrollment.

By enrolling in a subscription, you expressly agree that:

• Your subscription will automatically renew at the frequency disclosed during enrollment;
• Your selected payment method may be charged automatically for each recurring order;
• Applicable taxes, shipping costs, and other disclosed charges may be added to each renewal;
• The amount charged may change if prices, taxes, shipping costs, or subscription selections change; and
• Your subscription will continue until you cancel it in accordance with these Terms.

We may use a third-party subscription-management provider to administer recurring orders, payment attempts, account access, renewal notices, subscription changes, and cancellations.

You are responsible for maintaining accurate billing, payment, contact, and shipping information. If a recurring payment fails, we or our service provider may retry the payment method as permitted by law and the applicable payment network.

We may pause or cancel a subscription because of failed payment, suspected fraud, product unavailability, discontinued service, misuse, legal requirements, or violation of these Terms.

Any subscription discount applies only while the subscription remains active and eligible. Canceling a subscription may result in the loss of subscription pricing or benefits.

8. Subscription Changes and Cancellation

You may manage, modify, pause, or cancel an eligible subscription using the options available through your customer or subscription-management account. You may also request assistance by emailing [email protected] .

Cancellation requests must be received before the applicable subscription order is processed. Once a renewal order has entered processing or fulfillment, cancellation of the subscription will prevent future renewals but may not cancel or refund the order already being processed.

Canceling a subscription does not automatically cancel an order that has already been charged, submitted for fulfillment, or shipped.

If you change your shipping address, delivery frequency, product selection, or payment method, the change may apply only to future renewal orders. You are responsible for reviewing the effective date of any requested change.

Where required by applicable law, we will provide renewal notices, cancellation methods, or other subscription disclosures.

9. Shipping and Delivery

Shipping options, estimated delivery periods, and applicable charges will be displayed during checkout when available. Delivery estimates are provided for convenience and are not guaranteed arrival dates.

Processing and delivery may be affected by carrier delays, severe weather, holidays, supply shortages, incorrect addresses, customs procedures, service interruptions, or other circumstances outside our reasonable control.

You are responsible for providing an accurate, complete, and deliverable shipping address. Additional charges caused by an incorrect address, refused delivery, unsuccessful delivery, or address correction may be your responsibility where permitted by law.

Title to and risk of loss for purchased products pass as provided by applicable law. Delivery scans and other carrier records may be used to determine whether a shipment was delivered.

If tracking shows delivery but you cannot locate the package, check nearby delivery areas, household members, neighbors, and the carrier before contacting us.

You must notify us promptly about a shipment that is missing, damaged, materially incorrect, or incomplete. We may request photographs, packaging information, tracking details, or other reasonable evidence before providing a replacement, refund, or other resolution.

10. Manufacturing, Fulfillment, and Supliful

Revival Strips may use third-party manufacturers, suppliers, warehouses, fulfillment providers, and shipping carriers to produce, package, process, and deliver orders.

Our current fulfillment arrangements may include Supliful. When you place an order, information necessary to fulfill and deliver it may be provided to Supliful and other relevant service providers.

The use of a third-party manufacturer or fulfillment provider does not create a contract between you and that provider unless separately stated by the provider.

Manufacturing and fulfillment timelines may vary. An order may enter production or fulfillment shortly after it is submitted, which may prevent us from changing or canceling it.

We may change manufacturers, suppliers, fulfillment providers, packaging, shipping carriers, or operational processes without advance notice, provided that we continue to comply with applicable law and fulfill accepted orders as reasonably required.

11. Refunds, Replacements, and Non-Returnable Products

All sales are final except when a refund, replacement, or store credit is approved under our Refund Policy or required by applicable law. Returns, refunds, replacements, and store credits are governed by our Refund Policy as posted on the website. The Refund Policy is incorporated into these Terms by reference.

If you are unhappy with your purchase or believe that your order is damaged, defective, incorrect, incomplete, or missing, you must contact us within seven days after the product is delivered.

To request assistance, email [email protected] and include:

• Your name and order number;
• A description of the issue or concern;
• Clear photographs of the product, packaging, and shipping label when applicable; and
• Lot, batch, or expiration information when applicable.

Please do not discard the product or its packaging until we have reviewed your request. We may request additional information or documentation that is reasonably necessary to evaluate the claim.

Contacting us does not guarantee a refund, replacement, or store credit. Each request will be reviewed individually in accordance with our Refund Policy and applicable law.

If a claim is approved, Revival Strips may provide a replacement, store credit, or refund to the original payment method, depending on the circumstances.

Unless otherwise required by law, we generally do not provide refunds, replacements, or store credits for:

• Requests submitted more than seven days after delivery;
• Personal taste preferences;
• Dissatisfaction with the product’s effects or results;
• Failure to follow product directions, serving information, or warnings;
• Products damaged through misuse or improper storage;
• Orders delivered to an incorrect or incomplete address supplied by the customer;
• Products purchased from an unauthorized third-party seller;
• Gift cards; or
• Fraudulent, abusive, duplicated, unsupported, or otherwise ineligible claims.

Individual experiences may vary. We do not guarantee that a product will produce any particular wellness, energy, focus, performance, or other result.

Approved refunds will generally be issued to the original payment method. Please allow up to 10 business days for processing. Your bank or payment-card provider may require additional time to post the refund to your account.

Original shipping charges are generally nonrefundable unless the refund results from our error or reimbursement is required by applicable law.

Nothing in this section limits any consumer rights or remedies that cannot legally be waived.

12. Promotions, Discounts, and Promotional Codes

Promotions, discounts, referral credits, gifts, and promotional codes may be subject to separate rules, eligibility requirements, expiration dates, product restrictions, minimum purchase amounts, or other limitations.

Unless expressly stated otherwise:

• Promotional codes cannot be combined;
• Discounts cannot be applied retroactively;
• Promotions have no cash value;
• Promotions are limited to one use per customer or household;
• Promotions apply only to eligible products and orders;
• Subscription discounts apply only while the subscription remains active and eligible; and
• Shipping charges, taxes, and other fees may not qualify for a discount.

We may modify, suspend, or end a promotion at any time where permitted by law. We may reject or cancel promotional use involving fraud, abuse, manipulation, unauthorized duplication, resale, or violation of the promotion’s rules.

13. Customer Accounts

Certain features of the Services may allow or require you to create a customer or subscription-management account.

You agree to provide accurate, current, and complete account information and to update that information when it changes. You are responsible for maintaining the confidentiality and security of your login credentials.

You are responsible for activity conducted through your account unless the activity results from circumstances for which you are not legally responsible.

You must notify us promptly if you believe your account, password, payment information, or personal information has been accessed or used without authorization.

We may suspend or terminate an account if we reasonably believe that:

• The account contains inaccurate or fraudulent information;
• The account has been compromised;
• The account is being used for unauthorized resale;
• The account is being used to violate these Terms;
• The account presents a security, payment, or fraud risk; or
• Suspension or termination is required by law.

Account suspension or termination does not eliminate obligations arising from orders, charges, disputes, or conduct occurring before the suspension or termination.

14. Acceptable Use and Prohibited Conduct

You may use the Services only for lawful, personal, and legitimate purposes. You must not use the Services to:

• Violate any applicable law, regulation, or legal requirement;
• Infringe or misappropriate another person’s rights;
• Submit false, misleading, fraudulent, or incomplete information;
• Place orders using an unauthorized payment method;
• Purchase products for unauthorized resale, redistribution, or commercial exploitation;
• Circumvent product limits, promotion restrictions, account controls, or security measures;
• Scrape, copy, collect, monitor, or extract website content or data through automated means without our written permission;
• Reverse engineer, interfere with, disrupt, damage, or overload the Services;
• Introduce viruses, malware, harmful code, or other destructive technology;
• Attempt to obtain unauthorized access to an account, system, network, or information;
• Impersonate another person or misrepresent your identity or affiliation;
• Harass, threaten, deceive, exploit, or harm another person;
• Send spam, unauthorized advertising, or unsolicited messages; or
• Use the Services in a manner that could damage Revival Strips, our customers, service providers, or reputation.

We may investigate suspected violations and cooperate with law enforcement or other authorities when required or permitted by law.

15. Intellectual Property

The Services and their content—including the Revival Strips name, logos, product names, graphics, packaging designs, photographs, videos, text, website design, icons, illustrations, slogans, software, and other materials—are owned by or licensed to Revival Strips and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for your personal, noncommercial use.

Unless we provide prior written permission, you may not:

• Copy, reproduce, modify, republish, or distribute our content;
• Use our trademarks, branding, or product images commercially;
• Create derivative works based on our content;
• Remove copyright, trademark, or ownership notices;
• Frame or mirror any portion of the Services;
• Use our content to suggest a false affiliation or endorsement; or
• Use our content, product presentation, or branding to sell counterfeit, unauthorized, or competing products.

No rights are granted by implication, estoppel, or otherwise except those expressly stated in these Terms.

16. Reviews, Feedback, and User Submissions

You may have opportunities to submit reviews, photographs, videos, comments, testimonials, suggestions, questions, or other content (“User Content”).

You retain ownership of User Content you create. By submitting User Content to us or through the Services, you grant Revival Strips a worldwide, nonexclusive, royalty-free, fully paid, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from that User Content in connection with our business, products, Services, and marketing, subject to applicable law.

You represent and warrant that:

• You own or control the necessary rights to the User Content;
• You have permission from identifiable individuals appearing in the User Content;
• Your submission is truthful and reflects your honest experience;
• Your submission does not infringe another person’s intellectual property, privacy, publicity, or other rights;
• Your submission is not defamatory, fraudulent, or unlawful; and
• You will disclose any material relationship, payment, gift, discount, or incentive connected to the submission where required by law.

We may monitor, edit, decline, or remove User Content at our discretion, but we are not obligated to do so except as required by law.

Product reviews and testimonials describe individual experiences. They do not guarantee that another customer will receive the same results.

Suggestions and general feedback may be used without restriction or compensation, unless otherwise agreed in writing.

17. Third-Party Services and Links

The Services may rely on or contain links to third-party platforms, applications, payment processors, subscription providers, fulfillment companies, shipping carriers, social-media services, and other websites or resources.

Third-party services are governed by their own terms, policies, and practices. Revival Strips does not control and is not responsible for the content, availability, security, accuracy, products, or practices of an independent third party.

A link, integration, or reference to a third party does not necessarily constitute our endorsement of that party.

You are responsible for reviewing the applicable third-party terms and policies before using an external service or completing a transaction through it.

Complaints, claims, or questions involving a third party’s independent products or services may need to be directed to that third party.

18. Privacy

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the Services, you acknowledge that information may be processed by Shopify and by service providers involved in payment processing, subscription management, fraud prevention, analytics, marketing, manufacturing, fulfillment, and shipping.

Please review our Privacy Policy before using the Services or submitting personal information.

19. Errors, Inaccuracies, and Availability

The Services may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical issues involving product descriptions, ingredients, pricing, promotions, shipping charges, delivery estimates, product availability, or other content.

We reserve the right to correct errors, update information, modify the Services, or cancel affected orders at any time where permitted by law, including after an order has been submitted.

If we cancel a paid order because of an error or product unavailability, we will issue an appropriate refund.

We are not obligated to update, amend, or clarify information except as required by law. A date displayed on the website should not be interpreted to mean that all information has been modified or updated as of that date.

We do not guarantee that the website, products, subscription features, customer accounts, or other Services will always be available, uninterrupted, secure, or error-free.

20. Disclaimer of Warranties

To the fullest extent permitted by law, Revival Strips disclaims all warranties and representations, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, timely, secure, accurate, complete, available, or free from errors, harmful components, or unauthorized access.

We do not warrant that a product will produce any particular physical, mental, wellness, performance, or other result. Individual results may vary.

Information provided through the Services is not a substitute for professional medical advice, diagnosis, or treatment. You assume responsibility for reviewing product labels and determining whether a product is appropriate for you in consultation with a qualified healthcare professional.

Some jurisdictions do not permit the exclusion of certain warranties. In those jurisdictions, the exclusions above apply only to the extent permitted by law.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Revival Strips and its owners, officers, employees, contractors, affiliates, licensors, suppliers, manufacturers, fulfillment providers, and service providers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages.

This limitation includes, without limitation, loss of profits, revenue, savings, business opportunities, goodwill, data, or use arising from or related to the Services, products, subscriptions, these Terms, or your inability to access or use the Services.

To the fullest extent permitted by law, the total aggregate liability of Revival Strips for a claim arising from or related to a product, order, subscription, or the Services will not exceed the greater of:

1. The amount you paid to Revival Strips for the product, order, or subscription giving rise to the claim; or
2. One hundred United States dollars ($100).

These limitations apply regardless of the legal theory asserted and even if we were advised that damages were possible.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits such a limitation.

Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, these limitations apply only to the fullest extent permitted by law.

22. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Revival Strips and its owners, officers, employees, contractors, affiliates, licensors, suppliers, manufacturers, fulfillment providers, and service providers from claims, liabilities, damages, judgments, awards, losses, costs, expenses, and reasonable attorneys’ fees arising from or related to:

• Your violation of these Terms;
• Your unlawful or unauthorized use of the Services;
• Your violation of another person’s rights;
• Your User Content;
• Your fraudulent, negligent, or willful conduct; or
• Your unauthorized resale, redistribution, alteration, or misuse of a Revival Strips product.

We reserve the right to assume control of the defense of a matter subject to indemnification. You agree to cooperate reasonably with that defense.

This section does not require you to indemnify a party for conduct for which indemnification may not lawfully be required.

23. Governing Law and Disputes

These Terms and disputes arising from or relating to the Services, products, orders, or subscriptions will be governed by the laws of the State of West Virginia, without regard to conflict-of-law principles, except to the extent federal law or another applicable law controls.

Before filing a formal legal claim, you agree to contact us at [email protected] and provide a written description of the dispute and the resolution requested.

The parties will attempt in good faith to resolve the dispute informally for at least 30 days after receipt of the written notice, unless immediate action is reasonably necessary to preserve a legal right or prevent harm.

Unless applicable law requires otherwise, any court proceeding arising from or relating to these Terms or the Services must be brought in a state or federal court with appropriate jurisdiction in West Virginia. You and Revival Strips consent to the personal jurisdiction and venue of those courts.

Nothing in these Terms prevents either party from seeking appropriate relief in small-claims court where the claim qualifies or seeking emergency or equitable relief where legally available.

Mandatory consumer-protection rights available under the law of your place of residence are not waived by this section.

24. Changes, Suspension, and Termination

We may update these Terms periodically to reflect changes to our products, subscriptions, Services, technology, business practices, service providers, or legal obligations.

Updated Terms will be posted on this page with a revised Effective Date. When required by law, we will provide additional notice or request consent before material changes become effective.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by law.

We may modify, suspend, discontinue, or restrict all or part of the Services at any time. Where reasonably practical and legally required, we will honor accepted orders and provide appropriate notice concerning active subscriptions.

We may suspend or terminate your access to the Services if you violate these Terms, engage in fraudulent or unlawful activity, create a security risk, misuse the Services, or fail to pay amounts lawfully owed.

Sections that by their nature should survive termination will remain effective, including provisions concerning payment obligations, intellectual property, disclaimers, limitations of liability, indemnification, disputes, and governing law.

Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, subscription disclosures, and other policies or terms posted through the Services, form the entire agreement between you and Revival Strips regarding the Services.

Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary. The remaining provisions will remain in effect.

No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or another provision later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, financing, or similar business transaction, subject to applicable law.
